Description
A New Beginning: The Holy See before and after Benedict XVI. Some Thoughts on the Canon Law concerning the Election of the Roman Pontiff. Starting from the historical moment of the papal renunciation by Pope Benedict XVI and the appointment of the Argentinean Cardinal Jose Mario Bergoglio as Roman Pontiff, by the name of Pope Francisc, this article proposes an overview of the canonical form related to the canonical election of Saint Peter’s Successor. After clarifying the concepts of “The Vacancy of the Apostolic See” and that of “papal renunciation”, this study will present the electoral procedure for choosing the new Pope, according to the form modified by the Apostolic Letter, issued motu proprio, Normans Nonnullas.
REZUMAT: Către un nou început: sfântul Scaun înainte şi după Benedict al XVI-lea. Reflecţii asupra legislaţiei canonice privind alegerea Pontifului Roman. Plecând de la momentul istoric al renunţării la pontificat a Papei Benedict XVI, şi asumarea funcţiei de Roman Pontif a Cardinalului argentinian Jorge Mario Bergoglio, Papap Francisc, articolul îşi propune o trecere în revistă a disciplinei canonice referitoare la alegerea canonica a Succesorului Sfântului Petru. După clarificarea conceptelor de Scaun Apostolic vacant şi renunţarea la funcţia de Roman Pontif, studiul prezintă procedura electorală de alegere a noului Papă conform disciplinei modificate de Scrisoarea Apostolică motu proprio Normas nonulas.
